Welcome to Esther & Ruth. We're glad you're here. These Terms of Service explain the ground rules for using our website, online store, products, services and communications (together, the "Services"). We've tried to keep them clear and readable.

In these Terms, "Esther & Ruth," "we," "us" and "our" mean Esther & Ruth Inc. "You" means the person using the Services or placing an order.

By using the Services or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Return & Exchange Policy. If you don't agree, please don't use the Services.

Eligibility and accounts

You may use the Services only if you can form a binding contract where you live. Our online store currently serves customers in the United States. If you create an account, please keep your login details secure; you're responsible for activity that happens through your account. Please give us complete and accurate information. Where permitted by law, we may decline, limit, suspend or cancel an account or order, including if we reasonably believe information is inaccurate or fraudulent, or that the Services are being used in violation of these Terms.

Product information and availability

We work hard to show our products, descriptions, prices and availability as accurately as we can. Screens vary, so we can't guarantee that every image or color will look exactly the same in person. Some products are available in limited quantities. We may change, discontinue or limit a product, promotion or price at any time, correct errors or omissions, and cancel or refuse an order where permitted by law.

Orders, pricing, and payment

When you submit an order, you're making an offer to purchase the products you selected. Your order confirmation means we received your order; it doesn't necessarily mean we've accepted it. Prices are shown in US dollars. Taxes, shipping charges and any discounts appear at checkout before you place your order. Payments are processed by third-party payment providers. Products are sold for personal use, not for resale. For group or corporate gifting, please contact us at support@estherandruth.com.

Pre-orders and split shipments

Some products may be offered for pre-order. The product page and checkout will tell you when an item is a pre-order and when we expect it to ship. Pre-orders are charged in full at checkout. Pre-order timing is an estimate unless we expressly say otherwise. An order with several pieces may arrive in more than one shipment.

Promotions, referral rewards and Founding Member perks
Discount codes and promotions are subject to the terms shown with the offer, including any expiration date. Unless stated otherwise, they can't be combined with other offers, have no cash value and can't be exchanged for cash.

Founding Member status recognizes our earliest customers with perks such as early access and founding pricing. It is not an investment and does not give you any financial stake in Esther & Ruth or any fund. Referral rewards are a discount or free product earned for a specific, direct referral, are capped as described in the program details, and are not commissions on anyone else's purchases. We may change or end these programs at any time, as permitted by law.

Shipping, returns, and product use

Our Shipping Policy explains shipping, delivery, tracking and what to do if something goes wrong in transit. Delivery dates are estimates, not guarantees. Our Return & Exchange Policy explains eligibility, timing, exclusions, exchanges and refunds. Nothing in these Terms limits rights you have that can't be waived under applicable law.

Esther & Ruth offers cosmetic personal-care products and a dietary supplement. Please read all labels, directions, ingredient lists and warnings before use, and use products only as directed. If you have a known sensitivity, check the ingredients and consider a patch test first. Stop using a product if irritation or another reaction occurs, and seek professional care if needed. If you're pregnant, nursing, taking medication or managing a health condition, please talk with your healthcare provider before using our products, especially The Naomi supplement.

Our cosmetic products are designed to improve the look and feel of hair and skin. They are not drugs and are not intended to treat hair loss or any medical condition. Results vary from person to person and build over time.

Statements about our dietary supplement have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Information on the Services is for general education and product information. It is not medical advice and isn't a substitute for talking with your doctor.

Intellectual property and acceptable use

The Services and everything on them, including text, product names, photographs, graphics, logos, designs and trademarks, are owned by or licensed to Esther & Ruth and protected by intellectual-property laws. You may use the Services for lawful personal shopping and information. You may not copy, reproduce, distribute, modify, display, sell, license or otherwise exploit any part of the Services without our written permission, except as allowed by law.

Please don't use the Services for unlawful, fraudulent or harmful purposes; interfere with security or access controls; introduce harmful code; scrape or use automated tools without permission; impersonate anyone; or violate anyone else's rights.

Feedback and third-party services

We love hearing from you. If you submit a review, testimonial, photo, comment or other content, you confirm that you have the right to share it and that it's accurate and lawful. By submitting it, you give Esther & Ruth a non-exclusive, worldwide, royalty-free license to use it to operate, promote and improve the Services, subject to applicable law and our Privacy Policy. We'll ask your permission before featuring your name, photo or personal story in our marketing.

The Services may link to third-party websites or services. Your use of those is governed by their own terms and policies.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Services and products are provided "as is" and "as available," without warranties of any kind. Some jurisdictions don't allow certain warranty exclusions; where that's the case, these exclusions apply only to the extent permitted by law. To the fullest extent permitted by law, Esther & Ruth will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages. Our total liability for any claim will not exceed the greater of the amount you paid to Esther & Ruth for the product or service giving rise to the claim during the 12 months before the claim, or $100 USD.

Governing law and contact

These Terms are governed by the laws of the State of Illinois. Any dispute will be brought exclusively in the state or federal courts located in Cook County, Illinois, unless applicable law requires otherwise.

We may update these Terms from time to time. When we do, we'll post the new version here and update the "Last updated" date.
